📜 Rate My Golf Swing – End User License Agreement (EULA)

Effective Date: March 19, 2024

This End User License Agreement ("Agreement") is between you (the "User") and Rate My Golf Swing ("we," "us," or "our") and governs your use of the Rate My Golf Swing mobile application (the "App"). By downloading or using the App, you agree to this Agreement.

1. License Grant

We grant you a limited, non-transferable, non-exclusive, revocable license to use the App for personal, non-commercial purposes on any Apple-branded products that you own or control, subject to the App Store Terms of Service and this Agreement.

2. Subscriptions & Access

a. Subscription Tiers

We offer two auto-renewing subscription plans:

  • Monthly Gold Membership – $9.99 USD per month. Includes access to all training tools and ad-free experience.
  • Annual Gold Membership – $69.99 USD per year (approximately $5.83 USD per month). Includes access to all training tools and ad-free experience.

Both memberships include:

  • Unlimited access to training content and features
  • Removal of all in-app advertisements

b. Free Trial

Eligible users may receive an introductory free month, after which the subscription will auto-renew unless canceled at least 24 hours before the end of the trial period.

c. Payment and Renewal

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled in your Apple ID settings at least 24 hours before the end of the current period.

d. Cancellation

You can manage or cancel your subscription via your Apple ID account settings. Deleting the App does not cancel your subscription.

3. Ownership & Restrictions

All rights, title, and interest in and to the App remain with us. You may not:

  • Copy, modify, or create derivative works based on the App
  • Reverse engineer or extract source code
  • Rent, lease, lend, sell, or redistribute the App

4. Termination

This license is effective until terminated by you or us. Your rights under this license will terminate automatically if you fail to comply with any terms.

5. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind.

6. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages arising out of your use or inability to use the App.

7. Data & Privacy

Use of the App is subject to our Privacy Policy, which describes how we collect, use, and protect your personal data.

8. Governing Law

This Agreement is governed by the laws of California, without regard to conflict of laws principles.

9. Apple-Specific Terms

This Agreement is between you and us, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, Apple will refund the purchase price, if any, and has no further warranty obligation.

By using Rate My Golf Swing, you acknowledge that you have read and understood this Agreement and agree to be bound by it.
